TSHWANE - If the City of Tshwane took its responsibilities seriously, it could find solutions for the plight of squatters who have settled illegally on private land next to the Itireleng informal settlement near Laudium, a High Court judge said in Pretoria yesterday.
Judge Pierre Rabie granted a second eviction order to private land owners Goloden Thread Ltd, giving illegal squatters on the land until March 29 to move out.
The Sheriff of the High Court was authorised – with the help of the SA Police Service if necessary – to remove the squatters and demolish their shacks from April 1 if they failed to do so themselves.
Judge Rabie said there was no doubt that the squatters who have invaded Golden Thread’s land were unlawful occupants who have been there less than six months and had no right to move onto the land.
Most of them have moved in over the past month in contempt of an interim court order forbidding new occupiers to settle on the land.
The owners of the properly realised if the situation carried on, the occupiers would establish rights which would make it difficult to evict them. Judge Rabie said there was no sewerage, water or electricity on the property and that it was on unstable land which was unsuited for permanent residence.
He said the owner was entitled to protect his property and had acted with speed.
